Affiliate Program Terms

I. Definitions

  1. This Affiliate Program Agreement (“Agreement”) is entered into by and between “Atanasov & Atanasov” Law Firm, UIC: 177465618, a law firm registered in Sofia, Bulgaria, 27 Lyben Karavelov St, specializing in delayed or canceled flight compensation claims (hereinafter “Claim Navigator”), and the participants in the program (hereinafter “Affiliate”).
  2. By participating in the program, the Affiliate agrees to the terms and conditions outlined in this document.

II. Affiliate Responsibilities

  1. The Affiliate will promote Claim Navigator’s flight compensation services to its customers and third parties affected by flight delays or cancellations.
  2. The Affiliate may distribute approved marketing materials provided by Claim Navigator, including banners, brochures, referral links, and client information forms.
  3. The Affiliate will not make misleading claims, such as guarantees of success or guaranteed specific compensation amounts, to customers.
  4. All marketing and referrals must comply with applicable laws, including GDPR and consumer protection standards.

III. Commission

Depending on their plan, the Affiliate will earn a commission of the Service Fee (20% without VAT) collected from every successful compensation claim submitted by customers through their referral link, in the following amounts:

All newly registered affiliates receive a commission according to the "Basic" plan unless explicitly agreed otherwise.

Upon completion of over 100 successful claims, the Affiliate automatically starts receiving commission according to the "Premium" plan.

IV. Payment Terms

  1. Commissions will be paid to the Affiliate based on their selected payment frequency: monthly or quarterly.
  2. The Affiliate must notify Claim Navigator of their preferred payment schedule upon joining the program. Changes to the payment frequency must be communicated in writing and will take effect at the start of the next billing period.
  3. Payments will be made within 15 business days after the end of the selected billing period.
  4. Minimum commission payout threshold is €50.
  5. Payments will be processed via bank transfer.
  6. The Affiliate is responsible for providing accurate and up-to-date payment details.

V. Transparent Reporting

  1. Claim Navigator will maintain a reporting platform where Affiliates can track:
    • The number of claims referred;
    • The success rate of those claims;
    • Pending and paid commissions.
  2. Access to the platform will be provided upon program enrollment.

VI. Customer Interaction and Data Protection

  1. The Affiliate will ensure that referred customers are fully informed about the claims process, including eligibility criteria, timelines, and Claim Navigator’s fees.
  2. The Affiliate must comply with applicable data protection requirements when sharing data with Claim Navigator.
  3. Claim Navigator will handle all communications and legal proceedings related to the compensation claim after the referral.

VII. Confidentiality

Each Party agrees to keep all non-public information about the other Party, its operations, or its clients confidential.

VIII. Intellectual Property

All materials provided by Claim Navigator, including logos, templates, and tracking systems, remain the property of Claim Navigator and must not be altered without permission.

IX. Termination of Agreement

  1. Either party may terminate this Agreement with 30 days’ written notice.
  2. Claim Navigator may terminate the Agreement immediately if the Affiliate breaches any terms, such as non-compliance with marketing guidelines or unethical practices.
  3. Upon termination, no new commissions will be generated, but pending eligible commissions will be paid.

X. Liability

  1. Claim Navigator is not responsible for any damages arising from the Affiliate’s actions or representations, including marketing practices or guarantees made to customers.
  2. The Affiliate agrees to indemnify Claim Navigator against any claims or liabilities, fines, or damages arising from unauthorized, unlawful, or unethical marketing practices, including but not limited to: misleading customers about guaranteed compensation outcomes, violating applicable laws (such as GDPR or consumer protection regulations), or making unauthorized or false claims about Claim Navigator’s services.

XI. Penalties for Prohibited or Misleading Practices

If the Affiliate engages in any unlawful practices or makes guarantees to customers without Claim Navigator’s consent:

  • Immediate Termination: The Agreement may be terminated immediately without prior notice.
  • Forfeiture of Commissions: All pending and future commissions will be forfeited.
  • Reimbursement of Damages: The Affiliate will be liable for reimbursing any financial or reputational damages incurred by Claim Navigator due to their actions.
  • Legal Action: Claim Navigator reserves the right to pursue legal action, including claims for compensation or penalties, as allowed under Bulgarian law.

Examples of prohibited misleading practices:

  1. Guarantees of Compensation: Claiming that the customer is guaranteed to receive compensation, regardless of their eligibility or case circumstances (e.g. “You will definitely get €600”).
  2. False or Exaggerated Claims: Suggesting that Claim Navigator has a 100% success rate or special influence (e.g. “We win every case”).
  3. Unlawful Use of Customer Data: Collecting, storing, or sharing customer data without proper consent, in violation of GDPR.
  4. Unapproved Marketing Content: Using marketing materials or promotional statements that have not been approved, including altered logos.
  5. Misrepresentation of Fees: Failing to clearly disclose the service fee or implying the service is free when fees apply on successful claims.
  6. Pressure Tactics: Pressuring customers by creating false urgency (e.g. “Submit your claim today or lose your rights!”).

All communication between the parties using the specified contact details shall be deemed valid and binding.

Each Party shall notify within 3 business days in case of change of the contact details.

XIII. Amendments

  1. Claim Navigator reserves the right to modify this Agreement with 15 days’ prior notice to the Affiliate.
  2. Continued participation in the program constitutes acceptance of the revised terms.

XIV. Governing Law and Dispute Resolution

  1. This Agreement is governed by the laws of Bulgaria.
  2. Any disputes will be resolved through negotiation. If no resolution is reached, disputes will be referred to the competent Bulgarian court.

XV. Acknowledgment

By joining the affiliate program, the Affiliate agrees to these terms and conditions and acknowledges that they understand their role in promoting Claim Navigator’s flight compensation services.
